Terms & Conditions

These terms and conditions ("Terms") apply to Marathon in a Month November ("The Event") organised by Cancer Society New Zealand ("the Organiser").


The completion of the entry form constitutes your agreement to be bound by these Terms.


The Terms constitute the entire agreement between the parties and supersedes and cancels any previous agreement, understanding and/or arrangement, whether written or not. Any variation to the Terms must be in writing and signed by both parties.

ENTRY

Online entries to the Event will be open until 23:59 30 November.


To be eligible to participate in the Event you must:

  • Have completed the online registration;

  • Match the identification details on the entry form (entries are not transferable);

  • All participants under 17 must have the consent of a parent or guardian.

PARTICIPANTS UNDERTAKINGS

You agree that:

  • Prior to beginning training for the Event you and/or your child have sought medical advice;

  • The use of your name, image, photograph, video and comments may be used in any publication or marketing.

  • By creating a fundraising page you give permission to the Cancer Society of New Zealand photographers to take event photographs that you may feature in. Photographic rights will be retained by the Cancer Society of New Zealand and the images may be used for future marketing purposes.

INDEMNITY & ACCEPTANCE OF RISK

You agree to indemnify all persons, corporations, associations and bodies involved in promoting or staging the Event and their servants, agents, representatives, officers, employees, sponsors and volunteers, including the Organiser.

You agree to release the Organiser together with all other persons, corporations, associations and bodies involved in promoting the event from all actions, law suits, claims, proceedings, demands, losses, damages, penalties and fines however arising.

You accept that participation is at your own risk, that risk may include but is not limited to over exertion, dehydration, sunburn, injury, loss of personal belongings and accidents with other participants or spectators.


You are advised not to participate in the Event if you have had a fever or cold in the past week or have a hangover as these can contribute to exhaustion, dehydration or life threatening heatstroke.

TERMINATION

Failure to comply with these Terms will result in you being ineligible to take part in the Event and/or your withdrawal from the Event.


If for reasons beyond control of the Organiser the Event has to be cancelled or postponed you will not be entitled to a claim for any incidental costs.


PRIZES

A number of areas are offering local prizes, these are available to participants who sign up in that centre or division's local area depending on their structure. These prizes vary but please note for any accommodation prizes booking dates will be available at the discretion of the provider, no travel allowance will provided for local area prizes.

For any other local prizes please note these are not redeemable for cash. To enter the draw for an eligible prize you must raise $300, or be a part of a team which has raised over $3,000, achieving both of these will provide you with two entries. You will be contacted directly by phone if you have won a the local prize.

Cut off for fundraising to be eligible to go in the draw for a National prize is 11.59pm 10 December 2024.

Prizes will be drawn from all eligible participants at Addis House, 135 Ruahine Street, Palmerston North, NZ at 10am on 11 December 2024.

PARENTAL CONSENT

I acknowledge that my Child will participate in the Event run by Cancer Society of New Zealand (“Cancer Society”) on the condition that I consent to the conditions below.

  • Authority to give consent: I am a parent or legal guardian of my Child and have the authority to give consent on behalf of my Child to the matters set out in this document.

  • Age of Child: I confirm that my Child will be under the age of 17 years (as at the date of the Event).


Consent to participate: I agree that:

  • I have voluntarily requested to allow my Child to participate in the Event; and

  • I acknowledge that the Event involves physical exertion by my Child for recreational purposes; and

  • I acknowledge that my Child's participation in the Event is entirely at their, and my, own risk and that I may withdraw my Child from the Event at any time (and that this does not affect any rights we may have under the Consumer Guarantees Act 1993).


Consent for using Child’s email address: I agree that Cancer Society will use my Child’s email address to communicate with them about the Event and run the Event, e.g. encouraging them with fundraising. As this is an online Event, email communication is a necessary part of participation, and if I do not consent to this my Child cannot participate. Cancer Society will never share my Child’s email address with a third party.


Non-transferrable entry: I acknowledge that my Child’s registration is not transferable to any other person.


Acceptance criteria and date for entry: I accept that if my Child's entry form and payment is not received by Cancer Society by the online registration closing date for the Event, my Child may not be able to participate in the Event.


Consent to uses of personal information: I agree that my personal information (and my Child’s personal information) is collected and used by Cancer Society for the purposes set out in the Event privacy policy (https://www.cancer.org.nz/home/privacy/) including registering my Child, running the Event, providing any merchandise which I have purchased, (in the case of my information only) facilitating fundraising across all divisions of Cancer Society of New Zealand, and processing any donations made by me in relation to the Event.

Cancer Society may disclose my personal information (and my Child's personal information) in accordance with that privacy policy including to third parties who assist them to carry out those purposes such as Raisely and Sig Promo. If I withdraw consent to my personal information (or that of my Child) being used and disclosed as set out in this consent form prior to the Event occurring then I accept that my Child may not participate in the Event.
